Remote work: no general right, working time stays limited

Updated on October 24, 2026

No article of the Code of Obligations forces the employer to allow remote work, or the employee to impose it. The place of work follows from the contract, an instruction or an agreement. When work is done remotely, the agreed wage remains due under article 322 CO, and the working-time limits of the Labour Act still apply to employees covered by it. A political proposal on a right to disconnect does not replace the text in force.

What does not change at home

Remote work does not remove the reference under article 330a CO, the notice rules in articles 335b and 335c, or the protection in article 336c. The employer must still respect the employee's personality to the extent the employment relationship requires.
