Adult protection: personal measures before a deputyship
Updated on October 24, 2026
Adult-protection law in the Civil Code starts from the measures the person has taken. An advance care mandate names who will manage affairs if capacity is lost. A patient decree states which care is accepted or refused. The adult-protection authority orders a deputyship only if family support and those measures are not enough, and only to the extent necessary. The person is heard. There is no automatic general guardianship merely because of age.
What the code says
The advance care mandate is made in holographic or authentic form. It is deposited or registered so the authority can find it. Without a valid mandate, the authority assesses the suitable deputyship.
