Certificate of loss: the record of what the seizure did not cover
Updated on October 24, 2026
When the seizure or the realisation does not pay the creditor, the office issues a certificate of loss for the shortfall. It records that enforcement did not produce full payment. It does not replace a judgment on the merits if the debt was contested and not judged. It lets the creditor request a new seizure later if the debtor's situation improves, on the conditions and within the periods of the Act. For the debtor, the certificate appears in information that landlords or lenders may request.
What the DEBA says
Limitation of the claim recorded in the certificate follows the rules of the Act. Check the date of the certificate before paying an old reminder.
