Unpaid rent: enforcement and the lease are two procedures
Updated on October 24, 2026
The landlord may request enforcement for rent that has fallen due. The payment order and the ten-day opposition period in article 74 DEBA apply as for any other sum of money. That enforcement does not end the lease. The tenant's default and extraordinary termination are governed by the Code of Obligations, with periods of their own, distinct from the ten days for opposition. Contesting the amount in enforcement is not the same as contesting an increase on the official form under articles 269d and 270b CO.
What the DEBA says
Paying the office after the payment order stops enforcement for the amount paid. It does not by itself cure a notice already given under the lease.
