Executor: they administer, they do not inherit in place of the heirs
Updated on October 24, 2026
The Civil Code lets the testator charge one or more persons with carrying out the will. The executor takes possession of the assets, pays the debts, delivers the legacies and prepares the division. The executor represents the estate in those acts. They do not become owner in a personal capacity and do not replace the forced heirs. The task is paid according to the work and the assets, out of the estate. The heirs may demand accounts. If no one is appointed, the heirs administer themselves, or the authority appoints an official administrator where the statute requires it. The appointment is made in the will or the inheritance agreement.
Text of the Civil Code
The person appointed may decline. The heirs cannot revoke them lightly: the testator chose them. A serious breach goes before the supervisory authority.
