Statutory heirs: the order in the Civil Code if there is no will

Updated on October 24, 2026

If there is no disposition on death, articles 457 onwards of the Civil Code name the heirs. Descendants inherit first, by head and by branch. If there is no descendant, the father and mother, then their descendants, come next. The surviving spouse shares with those relatives under article 462. The spouse's share is larger when sharing with the parents than with the children. An unmarried partner who is not in a registered partnership is not a statutory heir. They receive something only by will, inheritance agreement or a beneficiary clause in insurance. ch.ch publishes the outline. The shares are in the code on Fedlex.

Text of the Civil Code

The heirs acquire the estate as a whole when it opens, debts included, subject to disclaimer within the statutory period.
