Holographic will: all by hand, dated and signed

Updated on October 24, 2026

Article 505 of the Civil Code allows a holographic will if it is written out in full, dated and signed by the testator's own hand. A typed text, even if signed, is not a holographic will. The date states the day, month and year. The signature identifies the author. The testator must have capacity. The will cannot set aside the forced heirs' reserve. It may be deposited with a notary or the competent office so that it can be found. The public will is another form provided by the code. An email or a note on a phone does not satisfy article 505.

A later valid will revokes the earlier one to the extent they conflict. Destroying the only copy with the intention to revoke produces revocation.
