Ending a lease: the Code, the contract and local custom

Updated on October 24, 2026

Articles 266a onwards of the Code of Obligations govern the end of leases of immovable property. For a dwelling, the period and the date depend on the statute, on any longer period in the contract, and on local custom. There is not one moving-out day for every canton. Notice must meet the form required by statute or contract and reach the other party. Extraordinary termination for good cause follows article 266g CO.

Unfair notice by the landlord

Article 271 CO lets the tenant contest the landlord's notice within 30 days of receiving it if the notice is unfair. Article 271a gives examples, including notice given because the tenant asserts their rights. That review does not replace compliance with the notice period.
