The landlord's notice: 30 days to say it is unfair
Updated on October 24, 2026
The landlord may end an open-ended lease by observing the period and the date. Article 271 of the Code of Obligations lets the tenant seek annulment of the notice if it is unfair, within 30 days of learning of it. Article 271a covers in particular notice given during conciliation or a rent contest, or because the tenant insists on their rights. For the family home, article 266n requires the landlord to notify the tenant's spouse or registered partner separately. Otherwise the contest period does not run against that person.
Effect of contested notice
A contest does not remove the need to look for housing. It does stop the notice being treated as final while the authority has not decided. Any compensation if notice is annulled is distinct from an extension of the lease, which the tenant may also request under articles 272 onwards CO when the end of the contract would cause undue hardship.
