Subletting: the landlord's consent, refusal only in three cases

Updated on October 24, 2026

Article 262 of the Code of Obligations lets the tenant sublet all or part of the property with the landlord's consent. The tenant has that right only if they tell the landlord the terms of the sublease. The landlord may refuse only if the tenant refuses to disclose them, if the terms are unfair compared with the main lease, or if the sublease causes the landlord major inconvenience. The tenant answers to the landlord for the subtenant.

Platforms and the whole dwelling

Listing the dwelling on a platform without telling the landlord does not comply with article 262. A refusal outside the three statutory cases may be challenged. A subrent that is unfair compared with the main lease is itself a ground for refusal.
